      My husband decided to claim me and found out that I have an offset that can take the entire refund. >.<
      What do I need to do to make sure that that doesn’t happen?
      Amend or just file the injured spouse?
      We are part of the PATH group as well.

          He did a joint return. (I have told him several years not to do that) but he did this year.
          I was told by the Department of Education to file an injured spouse form and send it in. And they won’t mess with his return. Since I never worked ( I am a stay at home mom). But I don’t know. :/

            I had a offset up until about a hr ago now I call it says it’s not showing any offsets, I called the irs to see if would tell me about it they said not till my 21 days is up. Does anyone know what might have happened

              He claimed you as a dependent or you guys filed together? If you guys filed together and you didn’t file injured spouse then that money will be taken but if he claimed you as a dependent I don’t believe they can take it as the return is under his social not yours

                File separately. Nothing you can do if there’s a federal offset- they’ll get their money somehow. At least if you do separate they won’t touch his.
