      If I am the full time worker and my husband is unemployed and has an offset, will filing an injured spouse work? I read that if we qualify for the earned income credit, that it will work.

          It says it can take 11 to 14 weeks, but that varies from person to person. Sometimes it takes less time, and other times, it can take months. Since you already efiled, you’ll have to wait until a letter comes in the mail to tell you about the offset and that they are taking your money. Then you’ll have to file the IS form, and wait 11 weeks from then MINIMUM. I’ve looked through several other forums and some people says it takes months, sometimes close to a year after that, since the IRS can take as long as they please at that point.

          You can check your transcripts online from the IRS website. Opt to view them online, as then you can check for updates (I’ve seen people comment that IS updates every Friday morning on transcripts.) You’ll want to check the Account Transcript when it prompts you to choose a reason after you log in (I’d suggest creating an online log in – you can choose guest but then you have to answer questions and fill out information each time.)

          You should see a 570 near the bottom of your transcript, that means the IRS is currently or should be reviewing for offsets. 971 means notice was issued, and something may or may not come in the mail (you’ll probably get something.) I believe it’s 571 that means the hold is lifted, and once you get an 846 code – it means they are sending you a refund.

            ashley, how long does it usually take to process your Injured spouse claim? How do you know that the IRS has even received your form, or do you file it electronically? We weren’t aware there was an offset and e-filed, so once we were aware of the offset we mailed the form. Sorry about all the questions, we have just never done this before.

              We’ve filed IS since 2011. Every year my debt agency takes the refund, n we get all of it back once my husband files the IS form.
