      I got married this year. My husband owes the IRS money. We have been on a payment plan for almost 3 years and have never missed a payment. I am assuming since we are filing jointly this year, they will be taking our refund to the owed balance?

      I am just not sure how that works.

          Yes unfortunately that is true. When my ex and I were going through a divorce he owed federal taxes and even though we filed separately they took a portion of mine to clear his debt. Ughh

            Not sure about the feds, but NY state did this with us a few years ago. Best of luck

              Yes 100% no exceptions. If you are entitled to some of the refund you can file injured spouse but it can take months. In these cases I would tell my clients to file separately.
