      Refund over $5000 and have an offset for back state taxes owed to a state I used to reside in. Didn’t even know my wife at the time. I’m a full time student and she has the only income. Can she file injured spouse and get what is basically her refund back? It’s not fair for her and our kids to pay for my screw up from years past. Any suggestions? Opinions?

          Yep, they waited till deposit time! My thoughts are that the refund WAS approved and DD WAS scheduled, just not to MY account☹️

          I agree Larry, you should get the balance after they take out what you owe. In my case, I owed MORE than my refund.

            Damn that is cold blooded for them to wait until deposit day to slap the 203 at you. Did the TOP show up with any debts or offsets, or was it all completely last minute?

            If your back taxes is $209 plus fees/penalties, I’m thinking under $500 bucks in total. You will get whatever is left from the refund deposited to your Emerald card on Tuesday night or Wed. morning.

            I’m am praying and hoping for the best for you, Larry. Good people seem to have it rough this year with taxes.

              I had this happen a couple years ago. My husband and I filed jointly and I owed student loans. WMR did still say refund approved for the amount on our taxes, however, the day it was supposed to hit our bank, WMR put up the offset msg and we got nothing (at that time). The entire refund was held bcoz of me owing student loans. The good news is that we filed an injured spouse for him and did get the whole refund, but it took a couple months. I don’t know what you owe but if it’s less than your refund, you should still get the remainder. I’m from KY too btw😊

                You can file injured spouse and the IRS should accept it. It’ll reverse the portion of the payment owed to her however, this won’t be a quick fix. Given the time of year you’re looking at 2-3 months.

                  You should ideally be completing the injured spouse form when you fill out your taxes and submitting the form with your taxes. You can submit the form now but there is no guarantee the irs will accept it.

                  How did you not know you owed the taxes? They usually send out multiple notices. Most states have a website where you can look up taxes owed by your name and social security number.

                  If it is only a couple of hundred, that is good news. Now you have that debt paid off.

                  There is no magic to this. Just plan better for next year. Make sure you have no debt and maybe use a CPA for any complicated matters

                  As for needing the money by the 28th, you could ask for an extension. Most creditors are great about one time extensions. You can look into personal loans. It sounds a little like maybe you are struggling to make ends meet though and that is a problem you need to look into fixing. Try having your wife make adjustments on her withholdings so that she is having less money taken out for taxes throughout the year. That will give you more money throughout the year, relying less on the lump sum of a tax refund. I know people here hate being told this but getting a large tax refund back doesn’t make financial sense. Your taxes refund should hit close to zero. Even owing the government a few hundred isn’t that bad.

                    If there is a textbook case of a hardship it’s our current situation. However it’s state I owe, not federal. She is due in a couple weeks, and we are already on a mortgage repayment plan. I’m a full time student finishing my Bachelors. We already have two kids, and my wife’s income is all we have. 2/28 is the point of no return for us. This week will make or break us. Do we have ANY options?

                      If we file separately we can’t get our EIC, which makes up the bulk of our refund. Would defeat the purpose. If I’m correct it’s $209 plus penalties and interest

                          Yes, she can file injured spouse. Also, I know this doesn’t help now, but maybe in the future you guys can file married separately.
                          Do you know how much in taxes you owe? If it’s only a few hundred then you guys would still get the remaining back.

                          I’m sorry this is happening. It seems like a lot of good family people are being offset with no warning this year.

                            I don’t have any clue what the amount of the offset is. All I know is that it’s the KY Dept of Revenue. That’s it. Didn’t get a letter in the mail. Nothing. Our DDD is for 2/27 and WMR is still showing full amount. Our mortgage payment is due by 2/28. We have the emerald card. Is there any chance we see ANY money on our emerald card this week? If not I’m gonna need to shit $1000 by Thursday.
