Okay so this might be a little long winded, I apologize.
So my husband and I have been married 1 year and this is my first time filing a joint tax return.
My husband is disabled through the VA so he makes no taxable income.I filed and we had a substantial return coming back, got hit with the PATH act no big deal.
Well it just updated today and we got smacked with the tt 203. I was confused because I don’t have loans or pay child support whatever. I called the number provided and it confirmed I owe nothing.
Well then I checked my husband’s and he was hit with 5 different debts that were accrued in his name by his ex wife when he was in the military and have her power of attourney when he went overseas for 15 months.
My question is: can I file injured spouse and send it now to the IRS before they offset the entire refund amount? It’s a lot of money but none of it is attached to my husband because he doesn’t work and the debt was accrued before we were married around 9 years ago.
Any help is appreciated
