I received a partial refund, and received the notice on WMR for tax topic 151. I have a feeling they are with holding the EITC portion of my refund and the tax topic 151 has to do with verification of my kids (niece and nephew) of whom I am their guardian. This will be my second year having them in my custody and claiming them on my taxes. I have not received the etter yet from the IRS, but want to be prepared. If I am needing to prove that I have the right to claim them what documentation will I need to provide? Our guardianship agreement was signed by their mother and notarized outside of the courts. Their mom voluntarily gave me the children and they were not removed by any sort of child protective services. I can provide the guardianship agreement, school records, medical records, but I’d like to be prepared and have everything together. My other concern is whether or not my return may have been flagged due to their mom receiving aid in the kids names. She does not work and does not file taxes so that would not have been the issue. However, I have a feeling she has been receiving welfare, food stamps, and/or housing in another state by saying the kids are in her household. If so, could that be why the IRS is verifying that I can claim them? And if that is the case, will she have legal ramifications for committing welfare fraud?
