      I received a partial refund, and received the notice on WMR for tax topic 151. I have a feeling they are with holding the EITC portion of my refund and the tax topic 151 has to do with verification of my kids (niece and nephew) of whom I am their guardian. This will be my second year having them in my custody and claiming them on my taxes. I have not received the etter yet from the IRS, but want to be prepared. If I am needing to prove that I have the right to claim them what documentation will I need to provide? Our guardianship agreement was signed by their mother and notarized outside of the courts. Their mom voluntarily gave me the children and they were not removed by any sort of child protective services. I can provide the guardianship agreement, school records, medical records, but I’d like to be prepared and have everything together. My other concern is whether or not my return may have been flagged due to their mom receiving aid in the kids names. She does not work and does not file taxes so that would not have been the issue. However, I have a feeling she has been receiving welfare, food stamps, and/or housing in another state by saying the kids are in her household. If so, could that be why the IRS is verifying that I can claim them? And if that is the case, will she have legal ramifications for committing welfare fraud?

          You are in big trouble because the mom getting assistants for them by using their ss number be prepared to answer to its how come you claimed for them good luck buddy

            When it happened to me i received partial refund with no notice it just hit my account before i ever got the first letter from irs. (VERY VERY PARTIAL, About 1/8 of my supposed refund. Credits Are on hold pending verification) however it’s been this long and i haven’t heard a peep from them. No movement, no response letter, no more of my refund. It’s really getting old.               I don’t think the benefits are related to this. I could be wrong but I don’t think they will affect/be affected with or by this situation. I had to send in everything to prove my biological children. The letter comes with a separate list of documentation acceptable for each credit &/or filing status they’re needing you to provide proof for. (EIC, ACTC, HOH) The things you typed in your first comment is the type of things on these lists: medical records, school records, notarized guardianship arrangement letter, utility bill, clothing and grocery receipts for children, birth certificates if they are not biological children, etc. I sent all my paperwork back on weds. I made 3 copies, I priority mailed a set to their physical address, I faxed a set to the fax number on the letter/response form and I filed a copy away to keep myself. I hope to hear something soon.                 Hey David, you said you received part of your refund with Tax Topic 151. Did they notify you that you would receive part of it or did it just deposit without notice?

                My fiance just got the same message. He was asked to send in docs for our 5 yr old (her last name is different) which we did. But still received that message. He’s been claiming her all her life.
