      So I file every year and I have a daughter. And I never give her father any of my tax return money Bc I take care of her. He doesn’t do anything for her or pay child support or even see her.

      His mother just told me today to not file my taxes Bc I was reported for fraud (by her) last year and this year.

      So what do I do about this and how do I find out information about this?

          If she did falsely accuse you of fraud to the IRS and you can prove it, then you can sue her for defamation.

              First of all, you should have never gave him or his mother your baby’s ssn. How did that even happen is what I would like to know? Second, if you take care of her full time then you are not obligated to split anything with the dead beat or his mother. F them

                His mother has her ss but I’m sure she will give it to him.

                And you all sound right to me. She said something a few months ago about if I file to give him half. He doesn’t do anything’s for her either.

                And yes I already filed the 24 anf accepted the 25.

                …like I always do.

                    Luke she told them you are filing fraudulent returns or something? Does the dad have her social security number bc it sounds like she wants him to file her instead of you. Don’t fall for it. If the IRS suspected fraud from you they would be requesting all types of things and threatening to make you pay back your refunds plus interest if you didn’t turn it all in. Uncle Sam doesn’t play.

                      I would file as soon as possible. If his mother or anyone else tries to claim your daughter after you have filed with her as a dependant their return will be rejected. A similar thing happened last year to the mother of my son, but with her daughter from another man. He had no right to claim her as a dependant but his mother made him do it. When her return was rejected, she called me and I advised her to call the IRS and provide the documentation to prove her daughter lives with her. It was a whole fiasco and she didn’t end up getting her return till nearly November. On the plus side, the guy is in prison now, which is probably best for everyone.

                        I guarantee she is saying that cause she wants her son to file before you. If you really take care of your child more than him then I wouldn’t listen to her and file ASAP!

                            File your return girl. If she had actually reported you last year, you would’ve had issues with your return last year they would’ve pulled you for auditing. If you were disallowed from claiming your daughter the IRS would’ve sent you something in the mail telling you just that & in the unlikely event that something goes wrong when you As long you can proof that your daughter lives with you 7 months or more and that you pay for everything. I went throughout this a few years ago with my sons dad. He had fraudulently claimed our son and I basically had to show documents that he lived with me and that I was the one paying for everyone. It was easy I just sent them his school/daycare records showing I paid, his medical insurance and a couple prescriptions & documents that came to my address. Don’t let her scare you. File your return sis & be prepared just in case they do happen to pull you for an audit.
