      Called around after getting jerked around for ages, in default was told the offset would occur 2/23, basically screwed right now right?

          I’m not sure wheree to begin. DOE, DOT, and FMS gave me the run around literally having me call each other in some twisted phone tag

            Thank you for that info!! I did get mine straightened out thank god. No offsets. But I wish I had known that with my husband. They gave him no warning and we thought they were within their rights so we didn’t dispute.

              I got tax offset code on wmr but nothing on the hotline. Any ideas about what that could mean?

                A intent to sue letter sent certified mail will take care of that.

                Don’t lay down, Wether you owe it or not, the law is 60 days that is clear, it will be thier burden of proof to prove they sent you a certified letter.

                  You can call 1-800-304-3107 I just did, stated my offset was paid which means refund processed my dd will be released got date today of 2/23

                    Yes, apparently I owe 11k, I had no idea I was in default nor got any certified mail, but was told by the DOT that I would be offset by the DOE on 2/23. Crushed.

                      If it ended in October, they had until Nov 31st to send you a letter. Yes student loans can be offset, however the offset law requires a certified notice be sent to you giving you a minimum of 60 days to make it right before they can offset you.

                      NOT verbal, has to be In writing sent to you via certified mail with proof. If you recieved no such letter you can’t be legally offset, if you do you have legal cause to go after them.

                          And yes. My husband had his taxes taken a few years ago. They took every red cent because his debt was more than his taxes. I’m sorry. I know exactly how it feels. That year (we weren’t married yet) and he claimed both of our kids as my income got us the better return. .. we ended up with zero tax return that year.

                            Did you call the offset line before at all? Was it listed? I had missed a few payments BC I didn’t realize my deferment ended in oct.. and they sent info to my old email. I got it straight but I was told by naviebt (my student debt holder) that they can still grab my taxes and the offset line can update daily.

                              Can’t promise you for sure, but the same thing happened to me 4 years ago. It absolutely screwed us beyond words. They took my whole refund.

                              Do you owe more than what your getting back this year on your refund?
