My sons father owes more than 27k in back child support. He gets a job, they garnish his wages for a few months and then he quits. This has been a repeated cycle for years. I guess I am wondering if they will still take his stimulus check despite the fact that they have been able to get a few involuntary payments from him. I have never received his tax return money assuming he allows taxes to be taken out of his check. I am not looking for a specific answer because I know one doesn’t exist. Just hopeful that someone has experience with child support and the IRS. Thanks in advance.

My question is.. will the treasury department send me a check for the remainder or did they send it all to child to do what they pls. Because they will. Someone lmk it’s the 24th

My baby daddy owes 1100 in arrears. I saw that my case worker submitted the information to the IRS. My ex would never tell me if he got an offset notice but im wondering if there is a way to find out if I’m receiving it? The offset hotline only works if you are the paying parent.

I live in a community property state, filed injured spouse for 2019, IRS has not processed return, and offset phone line said 2 offsets equal to economic impact payment ($3,400) will go to CS on 4/15
There is an IRS SAMS (Systemic Advocacy Management Submission) pending for this issue. For anyone else that submits a SAMS request, use issue number 42478. Doing so may help initiate change.

My husband owes child support but not that much. We got our stimulus yesterday and they did take out the child support but we got the rest deposited into our account like normal.

My ex owes 1200 child support arrears but no enforcement action has been taken. We do have a car with CSS and they take out of his check weekly but theyve made no.attempt to collect on the back support to this point. Will he still get the stimulus?

Don’t quote me, but if I’m correct, if you owe child support, a check will not be disbursed to you at all. Not even to pay the back child support to the state.
Do your own research though. I could be wrong.

My child support account shows that it’s been paid (he’s behind) and it’s pending for 4/20/20 and I believe it is from his stimulus payment.

They will take what is owed. Some people get their refund taken every single year. I think they should have allowed the stimulus money to go to everyone regardless of child support. I figured they would intercept thats too much money these agencies can collect to pass up.

Just what he owes. There is no kind of penalty. Just what he owes.

I work in that field. Initially they said it would not be intercepted. Today they changed and told us it can and will be intercepted, sorry all who owe.

So has anyone who owes child support has gotten their stimulus check ? Do you know about ?

The stimulus money cannot be earmarked for anything. Including, defaulted student loans, child support, wage garnishment, etc

It depends on if they have an order to take it, and the IRS actually manages to get it done. My ex somehow got his after not paying for several years. If they have a wage with holding order they probably have one for taxes but only your caseworker would know.

Yes that is exactly how it should work. Also remember that the $500 he claimed for his son as a dependent is supposed to go to his son. Just saying

He payed off irs and most of child support was just a balance of 700$ now that he owes child support, He claimed his son for 2019 so he will 1200, plus 500$ but they will take out 700$ ? And send him the rest?
-
April 14, 2020 at 10:48 am #4405268Unclereem
If he owes 700 in child-support they are going to take 700. They will not take money he owes the irs.

Earlygirl is that how much he owed 700$? So are they taking out from stimulus what they owe only and giving them what’s left from what they owe?
-

It’s been confirmed that anyone in arrears will have their stimulus payment held and sent to the state to the states child support office to reduce back.chikd support debt.

@earlygirly
Had he been making any payments to child support? How much did he owe? Have you received any of his stimulus money?
