Thats what i was going to ask WillBeas They are pretty good about granting deferments/forbearance. I guess they must have just ignored their statements or calls which is a huge NO NO. I was assigned to Nelnet and they are fantastic. Every time I have ever applied for a deferment or forbearance it has been granted. I know some are more tenacious so i guess anything is possible but you should never ignore your statements or their phone calls in most cases they are just trying to help.

My current status is Graduate Repayment Im not in collections or in default my current balance is 0$ I always apply for a forbearance so they wont take my refund.

You should always seek a deferment prior to the beginning of the year. They pretty much always grant the deferments although you end up paying more interest in the long run you will be able to keep your refund. I got one back in December and my next scheduled payment is in April.

No but it’s completely legal if you are delinquent on them and haven’t set up any sort of payment plan. It’s in your loan agreement.

I had a DDD every year and when that day came it changed to say it was offset

Hmm…long story short I found out the end of January that I was on the offset list…and I shouldn’t have been. I spent a week calling the dept of treasury the dept of education the loan holder EVERYONE. And finally the 2nd week of February I was removed from the list. My WMR says refund approved and the ddd date of 2/22 without any codes. If they take my refund and they shouldn’t have I will be so pissed. Had they rightfully taken it I wouldn’t even trip but knowing I’ve been paying all along and they take it smh

@Tay I have a DDD of 2/22/2019 …My WMF says refund approved with the full amount and it does have the code 203 ….Nothing on my transcripts or Offset line yet. I heard that it updates on the deposit day once the refund is sent to the Treasury Dept …This is my first year with a default loan im not sure how the process works. Ive been going off the experience of others that Ive read about

I have for the last 4 years. I went into a program last year and paid $5/month for 9 months to get my loans out of default so I am getting my refund this year. I can tell you that if this is the first year it happened. I was kicking with my sister the first year they took mine and has her print out an eviction notice and fill it out saying I was 6 months behind on rent in the total of over $2000 n sent it in and did everything they asked and that Sept I got the exact amount I was being on rent but it took about 6 months to get the check and they kept the rest of my refund but you have to call the US Dept of education and tell them you want to file hardship and they’ll tell you what ways you may qualify and you’re only allowed to do it once in your lifetime

Mine was referred to a collection agency a few months ago….When I tried to apply for a deferment or forbearance before that I was denied. My loan just went into default in 2018. I have been calling the Offset line once per everyday but I believe its gonna get taken on my DDD. If it does I guess at least majority of it will be paid. My loan is for 7700.00 and my refund is supposed to be 6000.00. I have read some peoples were taken and some not.

When it comes to federal loans, the IRS absolutely will take your refund to cover a defaulted loan. I believe–not 100%–anything over 90 days past due.

Everyone who had their refund taken were you in default on your loan? If you were current on payments that shouldn’t happen.

If you are married, your spouse can file the Injured Spouse form and you will get back your spouse’s portion of the return. You can also contact a tax advocate and apply for a hardship….you have to prove that without your refund money you face eviction/foreclosure/loss of utilities etc.

Yea my loan defaulted last year unfortunately I’m self employed and live in the Santa Barbara area. We had fires and mudslides couldn’t get work for months and I called the irs yesterday and they informed me that my refund was taken all 6k of it to pay the rest of my loans off 😒

It doesn’t take long to defer (3-4 days online). So, those who have not had a refund fully processed and owe on your loans, get it deferred ASAP and they can’t take your funds.
Stupidest thing I did 15+ years ago to get loans but have had them in deferrment or forebearance so they can’t touch refund.

I did. That sucked. I was tracking my refund for weeks. FINALLY it said “sent” but I never got it. Then when I called, they only provided me with a phone number to the company that took it. When i called them, not only did they take my entire refund, but they forced me to set up automatic payments for $325 or else they would automatically take $500 out every month of my bank account. That was the ABSOLUTE worst experience ever. Took me a year of $325/month before I could start making reasonable payments.

I believe this will happen to me but wont know for sure until Friday. The offset line says nothing so far but I read once the IRS approve your refund, they then send it to the Treasury Dept to see if it matches any debts. How okd are your student loans and did it give you any types of warnings before it took your refund?

Was it in default? I had over 150k in school loans at one point in my life; never had money reappropriated to pay down a balance.

@Joseph Yes, my entire $6k federal refund was taken to pay off my Perkins loan. Student Loans were the worst decision I could have ever made 15 years ago. I am so angry!!!😡😡😡

My wife did last year. Her school loan took all of our refund. $6,600 of it.
