      I posted earlier but dont see it anymore… i found out today i have an offset when i call the TOP line. I called the agency the debt is from and the only thing they could tell me was what my full balance was. They said they didnt see anything about being certified for an offset and even if they did garnish the return they could not say if it would be partial or the total balance. I have no idea what to make of it because I have read a few different things online. Some state its always 100% no matter what, others said partial depending on situation, and others have said that if you already have a payment plan set up they will not take any. Anyone have any idea? I just want to prepare myself for whats to come

          I found out today that I have an offset…it’s literally only $38 from 2014 lol. From what I understand it still processes normally BFS just deducts it and sends you the remainder.

            So update i was able to contact a sup with my loan servicer who made a compromise agreement. They are supposed to be sending info to the treasury to have the amount deducted from my return and then it is GONEE!!! Of course i would prefer they take none but this was they are only taking 2k instead of the whole thing 🤷‍♀️🤷‍♀️

                If you have paid a portion of the original debt, they may not collect any but the remaining balance, you do have rights and it is possible to appeal an offset and get your money back. I hope this helps, good luck.

                  So, sometimes the IRS simply won’t let them have it. That being said, there are some things that are true across the board, whoever the offset is with is a creditor, they are legally required to give you information about your debt. They must tell you the date the debt was incurred, the original balance and the remaining balance owed. If the IRS allows the offset, they may or may not allow the full amount.

                    I was offset last year due to student loans. They took an amount from both federal and state and paid the remainder of that loan. It did not take my whole return, so as long as you have enough to cover it, it will not be 100%. I researched and got nervous last year, but in reality it only took a few more days to receive everything, and refund was issued 2/27 last year. They did not direct deposit my refund as originally requested, both federal and state issued checks.

                      I don’t know you’re particular situation, or who the offset is to, but I will tell you my personal experience. We have an offset for the State of Illinois, have had for years. Every time I call the State, they tell my that the offset was disallowed by the IRS and that Illinois isn’t actively pursuing it, yet it stays on the offset line.

                        Mine is the same way. It’s not on my transcripts but it’s on the treasury offset line. The IRS doesn’t have to know about your offset to release your refund. They release your refund to treasury who matches your social security number to the debt they offset the amount and clear the debt and send you any remaining if there is any left. No way around it. If it’s there they will take it.

                            I the full balance will be paid giveth that your refund is enough to cover it and if it’s more than you will get what is left after offset is paid if you called 18003043107 and it said you have an offset than please believe you do

                              Update: The IRS says they see no offset…. i am so confused.
