      Has anyone received their full deposit despite a large offset being confirmed. My thoughts are if they tell you the date your offset will be deducted and you receive your deposit early to your bank, will they come for it through the bank?

          I have an offset coming… Which I’m ok with… But I see the State website showing my refund is being offset, but the IRS site still shows “Return Received”… So, will they take my whole State return since the offset is higher than my state return amount? Then supplement the difference from my federal return?

          And more importantly, will this delay my refund and direct deposit date beyond those who are getting it back within the 21 days?

          Guess I shoulda just mailed in that check 4 months ago and avoided all this crap!

            @Confused – With a DDD of 2/10, there is no stopping the offset. You will need to contact the company who is receiving the offset and discuss what the debt is, when it was acquired and so on. If you realize it to be a true debt you owe, then there is nothing that can be done. However, if it is not an actual debt, you can appeal. You do not appeal through the IRS or the Dept of Treasury, but through that specific company – in your case The Franchise Tax Board.

            If it is not a legit debt, they would need to return the funds to you; likely via check.

              I live in Texas, just today did I find out that I owe and have an offset California Tax debt? I have never lived or worked in California. EVER. The offset is for the Franchise Tax board. Has anyone ever experienced this? My DDD is on the 10th….I need to act fast.

                @MamaK – Yep, when owed a state debt, they WILL take from both fed and state returns. This is because the state does not update the fed that the offset was paid in time. Therefore, the fed processes it as well. Been there, done that! It takes about four weeks for the money to move from the IRS to the state. The state will then see this money is not longer owed and will mail you a check. Happened to us last year and again this year.

                  I have several resets thru the years and the government always have gotten their money first and then send me the remaining funds. One year the government put a left on my account and took my savings money.

                    I was wondering if I had an offset of $890, that they took from my state, why when I looked to see if I had a DDD, which I finally do, does it say all or some of my taxes may have been offset? So I called the Offset hotline and it gave the same amount already taken out from my state last week. I hope this doesn’t mean that they are slipping up and took it from BOTH!!!!

                      From my experience, they intercept your refund BEFORE it hits your bank… Even if you get a DD early, the government is aware that the treasury dept released those funds.

                      This has always been the case for ny buddy who owes child support arrears.

                        Because refunds are disbursed through the Treasury, any debts owed to the treasury are offset before a refund is issued. So it’s unlikely you will get away with a full refund if you have an offset.

                        That being said, offsets are updated weekly and returns are processed daily, so you could possibly get by the system.

                        But chances are unlikely.

                        only way around this, and I’m not well versed in how it works, is if the offset belongs to your spouse and you filed injured spouse form. They will let you have SOME of the refund since it’s not yours directly…
                        But still they are going to get a majority of their money.

                        Threes no way around it.

                          The IRS will not disburse your funds without disbursing your offset first.

                              They will notify you by mail that you need to pay it back, save youself the nightmare and make sure you dont spend it.
