      Hi I am married but I made more than my spouse. I have tried filing jointly and seperately. When I do it jointly we would owe, if I do it seperately we both get a refund. My question is I paid most of the bills for the year since my income was double the amount than my spouse. Can I file head of the household ?

          no children.. our children are all moved out. Hubby also had income. Just half of what I made for the year.

            You can only claim your spouse as a dependent under head of the household if he had no income and will not be filing taxes this year.

              Do you have children?

              If you have children, one of you can file head of the household while the other files as married filing separately. If not and you file separately, then you both have to file as married filing separately. Otherwise you can file jointly.

                You cna file separate and you can both use head of household and claim each EIC and CTC if it appplies. Just use a different address for him/you to make sure and give your husband at least 1 dependent if you guys have any.
