      Hey there. Question preferably for robroy but if anyone could help then great. My Husband is the injured spouse and he has 2 little ones in the house, mine are all grown and gone but I owe back child support because I was incarcerated for a time many many years ago for making a dumb choice. In any event, we e-filed an injured spouse form WITH our taxes 2019 and I was wondering if I have to contact DCSE to tell them that before they give my ex and his 5000 new kids all of the money? What are the chances they’ll take it all?

          I talked to the IRS today and they said the Injured Spouse place just opened yesterday so they are working on getting us half of our money but still is not right my kids shouldn’t have to pay for it. Everyone got hit by the pandemic. There getting a stimulus check also of their own and I’m sure half of the people don’t even work And they get our money!!!!!!!

            I live in a community property state, filed injured spouse for 2019, IRS has not processEd, and offset phone line said 2 offsets equal to economic impact payment ($3,400) will go to CS on 4/15

            There is an IRS SAMS (Systemic Advocacy Management Submission) pending for this issue. For anyone else that submits a SAMS request, use issue number 42478.

              I filed injured spouse for the first time. I haven’t gotten a letter or anything from them but received my state. Will I get my half of the stimulus check?? I’m so lost on this. They don’t have enough information on this.

                The same will apply with the Stimulus check as everything else but child support (i.e. student loan, etc) have been waived.

                  If you’re in a community state, they will take 1/2 of the refund and give it to your Ex (should be the kids, but you know that rarely happens).

                    Mine got offset. Had to file Injured Spouse

                      From what I’ve read, offsets are canceled right now so I’m thinking you will get the full stimulus without having to do anything further.
