      My tax guy said if you do this you can get half guaranteed. Is this factual!? I’m wondering cuz I owe IRS $XX00 and tax return of $XX00.

          If it is for this year I believe you have to file “innocent” spouse because “injured” is for AFTER they took money from you.

          The last year we were married my ex made some horrible mistakes with the taxes and didn’t tell me what he was doing. I lost my refund the first five years after the divorce. I found out about the injured spouse, filed it, and got a check for all of those years at the same time. I was pretty nice.

              It definitely takes longer than a few weeks. It think that it was like 12 weeks before I got anything, that is why I filed separately the next year, but didn’t get as good of a refund because you can not clam the credits.

                My tax guy filed Feb 10th with injured spouse form. He said Feb 27th. Some ppl say 11-14 weeks and other say different. It sucks.

                  You get back what the spouse would have gotten if filing separately, more or less. When I claimed it, I had to specify I’d have claimed our kids, etc, and did get back some child tax money, I think? But guaranteed half, no. Just whatever they would have received based on their income alone.

                  And it takes FOREVER! An extra 2-3 months when I did it, though mine was multiple years ago, so may be faster with efile/dd.

                      That is true- you will get what you “earned” and the other party’s will go to the debt. It takes a lot longer to get the refund.

                      If you file married filing separately, it will process faster, however I don’t think that you can claim EIC or CTC. That may have changed, so don’t quote me on it. ;)

                          Injured spouse will make it to where what she would get back will be taken and what you would get back will actually come back. It may not be half. For us we get all because I am the only one with income and my wife has the offset.
