I’m gonna be filing injured spouse this year. It’s on my husband’s student loans. We got payments set up but they still want to take it out of my refund. My husband didn’t work any last year so all money was, brought home by me. Does anyone know how much they’ll still take?

I had to file injured spouse last year. I would recommend getting an advocate if there is a reason you need it sooner than the 14 weeks they say it can and probably will take. If he did not work then all of the return is yours, but if you file injured spouse it takes a long long time! Some will tell you to file married filing separate, this is ok if you don’t take the EIC, but, if you do want that you have to file together. Otherwise you won’t get EIC if you file separate.

It does take much longer to get a return when injured spouse is filed. my husband and I had to file one year because of his child support arrears. I don’t know how they calculated how much was mine accept for the child tax credit for 2 child tax credits for my children from another marriage. I want to say that it was April when we finally got our return!

I filed injured spouse today and already got accepted. Has anyone else done this as well?

I heard it takes roughly 2 to 3 months to process injured spouse. However I’ve never had to file this way, so that is just speculation. Good luck!

If it is determined that all of the refund that would be given is yours, then after a little bit of a wait for them reviewing it, you should get all of your refund in full.
