      So my daughters grandma and me always have issues for 13 years now. I never give my daughters father any tax money because he doesn’t involve himself in her life or pay anything. I file my daughter every year.

      So a few months ago she said when I file taxes to give her son half.
      I filed Jan 24. And like a week later she said I was reported for fraud this year and last year…

      And today she sent me a message saying that she’s reminding me she’s filing her taxes today and “they” said I would be the one to get in trouble and if I haven’t filed my taxes then don’t and she’s filing for 2 years with my daughter on it.

      What should I think of this?

      I filed last year with my child and I already filed this year.
      Are they gonna reject her taxes or how does this work?

      My transcripts say my process date is the 18

          I’m pretty sure I already told you or someone else with this exact same situation before but she cannot legally claim your daughter unless she lived with her for more than half of the year & provided more than half of her support for the year. And if she’s trying to claim fraud both of you will have to provide documentation proving the previously stated & they will determine who is the rightful person who gets to claim the child this year. Sounds like scare tactics. If they don’t pay to support her they don’t get to claim her. Period.

            Hers will be rejected due to the SSN being used already. They have the option to paper file and then the IRS will ask for proof in about 6-10 weeks if she is eligible to claim the child. Examples, birth certificate school records medical records etc.

            She legally can’t claim the child because it would be a qualifying relative and that means if the mother or father can claim the child, that’s who it goes to.

            Now let’s say he files, the child has to live with him for more than half the year. If you guys split custody 50/50 it’s goes to the tie breaker which who ever AGI is higher gets to claim the child.
