I’m not ready yet to file but want to get all the info I can beforehand.

Here’s my situation. I’ve had legal custody of my grandchild since March 2018. I did not file her on my 2019 tax return but plan to on my 2020. Therefore her biological mother got both rounds of stimulus money for her. I also learned she claimed her on her 2019 taxes (grandchild has lived with me since Jan 2018). It’s my understanding I can file for those 2 stimulus payments since I would’ve been the one with the right to receive them. Am I wrong? I have all the custody court papers I assume they’ll want. Just hoping this won’t tie up my refund for months. And hopefully bio mom isn’t stupid enough to try and claim her again this year.

Ugh, yeah I figured there will likely be a delay. Only support mother provided was 1 pack of diapers in Feb 2019. Child support not ordered, they cant find her to serve her. Theres also been an order of protection in effect since June 2020 and mother hasn’t seen her since March 2020.

Yeah but it is going to be one hell of a hassle my woman went through this a couple years back and she did nt get her refund until july or august. so get ready to have everything delayed especially now with everything going on. You are going to have to prove that the mom didnt provide half the support even through you got custody that does not mean anything sorry about your situation.
