Last year I filed with my spouse (joint), and we filed with the Injured Spouse form. I never received an official letter of an offset before or after filing, other than the one my student loan debt was in collections and could be offset (bright yellow paper and it was about payment options to avoid potential offsets) unless I contacted the credit agency (Pioneer Credit Recovery). I did contact them last year, and told them I wanted to declare bankruptcy and they were going to send me some documents over payment options- but it didn’t happen.

Fast forward to this year and I know my account is in collections with them, but I still didn’t receive an offset letter after last year. We efiled with the form on 2/2 and got our refund by 3/20. I just don’t even know if it is necessary to file the form this year? Just like the 2018 tax year, I didn’t work in 2019 and only my spouse did. I obviously want him to get a return for the work he has done and don’t want to prolong the process in the event they might. I haven’t even received anything from the credit agency. Have people experienced offsets without getting anything about an offset? I did call the IRS 800-304-3107 and it just said I may have an offset with them. Last year when I called, they said they saw information but there was nothing indicating there actually would be interception, but they couldn’t guarantee that. I might just file the IS form to be proactive again.

I have never received any paperwork saying that our refund will be offset, but if I don’t send in the IS form, they take everything. If you file jointly, do the IS form.
