      My ex husband can claim our daughter this year but TT says I can claim her as a non dependent for EIC/HOH purposes. If I file before him will the IRS reject his returns because she’s on mine but only as a non dependent? When they asked if someone else can claim her I answered yes and I am not getting the child tax credit for her. Please help. I want to file today.

          Thank you, I will talk to someone. I know he made too much money for EIC and my other child qualifies me for HOH.

            talk to a tax preparer. That’s a new question. I would say he would be entitled for both credits. However if you worked last year you can claim her and receive eic. Not sure for non dependent, never seen that option. I do know only 1 person can claim head of household. If one person claims, then the other later on for head of household it will get rejected and you will have to send a paper form. Be careful, and ask a professional just to cover all Basis before filing.

              I’m not claiming her as a dependent for child tax credit, it says non dependent for EIC and head of household.

                If you file before the dad, his taxes will be rejected and he will have to mail in his taxes which takes months to receive. You both cannot have the child under your taxes unless it is joint. If you file without his knowledge, it wouldn’t be a good look on you.
