I am the custodial Parent, I am over over $7000 in back child support. The Noncustodial Parent works on and off each year, most years I receive nothing. This year the Noncustodial Parent filed his 2014 tax, married filing jointly (they were married 7/2014), I would like to know how I find out if the return was seized?

His case already has a seize order in effect with the local office (Schenectady NY), and other then his 2013 taxes he has NEVER filed a tax return (I did receive $160 something for the 2013 refund), but this is the 1st year he’s filed as married, and he didn’t contribute much to the 2014 net income. His wife on the other hand works, FT over 40hrs a week and she has a better then minimum wage job.

I called my local office and they said that they don’t seize her part of the refund, but I’ve been doing some research and according to Federal law they can (I think), as I meet all of the guidelines. I don’t receive any kind of state assistance, MY husband’s employer provides all the health insurance.

I know from the Noncustodial Parent that they are receiving over $5000 in federal refund money, and I want to make sure my daughter receives what is owed to her. Can someone provide any help with this information as I have already made all the calls I can and can’t get anywhere. I know that it can take anywhere from 30days to 180 days (or longer), but is there anywhere I can turn to to even see if I should be receiving anything?
