      I have a couple questions and not sure if anyone here can answer or not. My ex husband owes me almost 7 thousand in child support BUT he also owes the irs for back taxes almost 5 thousand. Will they take the back taxes before giving the back child support? If they take the back child support how long does it take to get back to me. He is claiming the kids this year (divorce decress states he can) Also when he calls the irs offset number it dont say he owes anything at all. Wouldn’t child support be on there?

          Also, the offset line is for non tax debt so child support would have been listed if it was to be offset for that reason.

            @ Kristy. The IRS always takes what is owed to them first. If anything is left then it would go to child support if the debt has been certified by Fiscal Services. He may slip through with child support but by next year it should intercept.
