      I’m owed back child support. If they intercept the refund how do I know if I will get it? Is it just a surprise or will it show on wmr? Also will it be sent to me as a federal refund, state, or go to my original child support form of payment? Will it be a lump sum deposit or will it be spread out? What if they file only a federal and avoid state to try and avoid child support. Will the IRS be able to know?

          As long as the return is not MFJ, the IRS will take the offset immediately and send it to OCSE for disbursement. This typically takes 4 to 6 weeks to get to you and shows up how you usually see your support show up.

          If they file MFJ, you could be in for a long wait. The IRS will take the offset immediately, but hold it up to 6 months to see if an injured spouse form is filed. This takes forever.

          If you are super unlucky, your ex is creative like mine and sets up a business in his wife’s name and has people write out payments to the company for work he did. Then they file it ALL as her income. I won’t see a single cent.

                Federal or state refund will be offset for child support. They will offset the entire refund to cover the entire amount due. Once the tax return is processed, the return will be either reduced or completely intercepted by child support. Child support gets first dibs on offsets. The money is withheld and sent to child support. Even though a return has been processed, and the refund or offset has been set, It still takes 4 weeks for child support to receive payments to account. Child support affects your credit rating, I don’t understand why someone wouldn’t want to file just to keep refund being sent to cover child support. Why wouldn’t you want your debt paid faster.

                  How did you know it was intercepted before hand? Were you notified by mail or something?

                    From past experience child support got submit in like april because if the person is married that person can file an injured spouse form to make sure their earnings don’t get taken

                      Both State and Federal refunds can be offset. Several years ago my ex had his Federal refund intercepted and I was sent a check. The back child support after intercept is sent through OCSE to the state child support agency to pay the past-due support. Then it is disbursed from there. From the time it was intercepted to the time I got it was about 6 weeks. Hopefully they’re quicker at that process than it was then.

                        Good luck hope he does. You may be able to call your state and IRS to see but if its all going to you hes probably.not in a hurry to file like the rest of us are. Its crazy. Hoping those kiddos get what they’re owed!

                            It was a surprise for me. I’m trying to think it was so many years ago but I think it was directly deposited on my child support card but not until April. I do not know when he filed though. The IRS won’t do anything about state I dont think. But state should apply to child support as well. Large sum however much they are able to take. No guarantee he will file though. My kids father didnt for years until the judge put it in the order he had to. My state is NY
