Hello! So, for 11 years, my husband and I have filed Married but separately. We decided to file joint his year, as he has about $1k back child support from when he was laid off. That way baby mama gets her chunk owed all at once and it’s done. My question is, how long does that make the rest of the refund delayed? Is it weeks or months, or does the system spit it out the same day the support is garnished (assuming that they take it, they may not.) Input? TIA!

Thanks, guys. I was a stay at home parent for a majority last year with our newborn; so, it does me no good to file separately. I made peanuts. Lol. I’ll just keep my hopes up and see what happens. …although, I didn’t know that about the recipient’s end. That’s a long wait for her. :-/

This is something I’d ask a tax professional. I believe on the recipients end they have to wait like 6 months to allow the spouse to file certain paperwork. Could you file separately and just pay it through your Department of Social Services?

The offset should not delay it at all. Especially with the path act waiting period.

I just had him jump on the offset line. There is most definitely an offset for the child support. Which is fine, it is what it is. I just don’t want the remainder delayed. 😭😭

I was under the impression that they would not take your refund for back child support unless there was an offset….. my husband (we just got married) there is no offset….. his case was closed and then they reopened it so he’s behind but not really so that maybe why but he has no offset……. hoping that meaning they won’t take it.
