I was accepted on 1/13 and Did Not have earned income credit or Child Tax credit and when I go to Where’s my refund tool it says:
Refund Status Results
Print. Take the survey.According to the Protecting Americans from Tax Hikes (PATH) Act, the IRS cannot issue refunds before February 15 for tax returns that claim the Earned Income Tax Credit or the Additional Child Tax Credit. This applies to the entire refund, even the portion not associated with these credits.
Check Where’s My Refund after February 15 for your personalized refund status. It’s updated once a day and remains the best way to check the status of your refund.Please read the following information related to your tax situation:

@herewego
I’m in the exact same boat. I think there was a batch that went through for early filers because I filed on 1/7 and was approved 1/12 with HOH and ACTC. Hope this means we’re good!
[Not sure what this means, but I was able to order both my transcripts yesterday and WMR showed 1 bar – I claimed EIC and ACTC. I went on and checked this morning bar is gone and I got the PATH message.]

I was able to order both transcripts last night (1/26/17). This morning both bars had disappeared and I now have this message (1/27/17).

@AM88
I remember that to a T, and I fully agree. I’m in the exact same boat as you. I file early every year. I’m talking 1/1 early lol. I had no problems until last year when the re-sequence occurred. I ended up getting mine (even with it being under review on 2/12. My cycle is 20160505 (weekly) which is probably why mine were done (transcripts available) today. Just a guess.

Yes, I have the EIC and ACTC and was able to order BOTH transcripts as of this morning. Whether that means anything this year or not remains to be seen. However, last year (I just went back through old posts from last year to verify all of this), we had the “resequencing” delay for early filers. We waited and waited as others got their refunds before us. Eventually though, I was finally able to order both of my transcripts via phone on 2/5, then on 2/6 we got updated with DDD’s of 2/10.

Okay guys, I’ll actually start a topic about about this call I made. It will be titled “Update on IRS Systems You want to Know!” Now, before I say this, know that I spent 30 minutes on hold, and I promise I’m not lying. I want my funds like everyone else, and being a father of 4, and married, I would play with anyone’s emotions. I took the initiative of writing the questions down, and asking them directly so there is no ambiguity. In other words, you can trust what I’m saying. Below are the questions I asked, and the answers to them:
1. When I ordered my transcripts it shows a processing date of 2/13. I thought because of the PATH ACT law you guys couldn’t send us our funds owed until 2/15. This has happened to several people in forums online, so I’m sure we all have a common denominator on this. Why is it showing this, and why is there a post dated processing date on 2/13 already?
Answer From Agent: Im not sure why it’s showing a processing date of 2/13. We have not had many calls about refunds yet, but I can tell you that the law says we cannot send funds from EIC or ACTC until after 2/15/17 (she said after, which was disheartening lol).
2. Okay, so why would the system put 2/13 for my processing date if we can’t receive funds until after 2/15?
Answer From Agent: I can’t tell you exactly why, because we really don’t know. Again, it’s not something we’ve had mentioned in my department. We don’t handle that. Did you have EIC or ACTC and your account said the process date of 2/13?
3. Yes it did me as well as many others online. So could you tell me if there has been anyone yet with EIC and/or ACTC that has received refunds yet, or DDD’s (I said DDDs, and she knew what I was referring to)?
Answer From Agent: I have not handled any case that has a refund yet, and as far as direct deposit dates, there are various systems people have to go through that are not in my department.
4. I really appreciate your answers. I have just 2 more. The first is about those systems. Are you saying that each case is handled by automated systems that check and verify everything?
Answer From Agent: That’s correct. The system is programmed to check ID verification, SSN, and whether or not returns need additional screening at that point we will look at the returns manually.
5. Okay, so during these checks the system does, even though the tax law for refunds have changed, is it possible for someone to have a DDD before 2/15, or does the system stop it because of the new law?
Answer From Agent: It’s possible for someone to have a DDD if they are cleared of the checks the system uses.
6. Oh wait. Just one more question. Will WMR update as usuall if dates are given, or will it hold to update until 2/15 for EIC and ACTC?
Answer From Agent: If there’s any updates to anyone’s account, it will reflect on WMR no matter what.
Please share this guys as much as possible. Should calm a lot of nerves as it sounds like the AI does it all, and it can determine if it’s okay to “pass” an account for a DDD, which according to this Agent, can happen as the system deem fit.
Good luck guys,
Shwa

I filed on the 1/22 and accepted on 1/23. Yesterday I couldn’t order any transcript and had to use my previous address but today I can use the new address plus order both transcripts. Also I have the EIC with two dependents. I believe the only ones affected are those who filed early! WMR is at one bar with tax topic 152 as normal. I talked to IRS on Tuesday when bars disappeared and was told that everything look good. She didn’t mention path act to me she just said u have 21 days from date accepted to see action which is the usual statement. But she didn’t specify waiting until the Feb 15th. I believe because I didn’t fall into that bracket of filing early. “By law” she would be obligated to specify the 15th but didn’t do so because I wasn’t a early filer. Anywho we have to speak this into existence and be positive about it. I have seen someone get approved with EIC and dependents. Some people just like to be negative about the situation. I hope more ppl with EIC and ACTC come share their experiences. Also I didn’t have ACTC just my same two dependents I always file and I never file early maybe a day at the most. Also since I just moved into my apartment this month from another state, I was able to submit my new DL which confirms my identity and new address. This would cause a uproar in America that low income families became homes less or lost things all because they had to wait on the hard work income. That wouldn’t be fair so Based off of their statement early files could be more at risk for extra precautions. I am sure this will be in a case by case basis as well. It would be too much chaos in this world.

@Nea
https://www.irs.gov/individuals/get-transcript is the website to order transcripts.
You have two options.
1) sign up for an online account. You will need things like Credit Card numbers, email, Cell phone, tax info.. etc.
2) Request by mail. You only need tax info and address. They take two weeks to receive by mail.

@spre I’m not going to argue. The actual bill can be found @ http://docs.house.gov/billsthisweek/20151214/121515.250_xml.pdf If you read section 201 – at the top of page 95, starting this year the IRS is prohibited by law to release refund prior to the 15th of the second month following the close of the taxable year for anyone claiming EITC or ACTC.
I didn’t make the rules, blame congress. Just trying to spread honest information so that people don’t get their hopes up. the IRS cannot release our money, law prohibits it.

@SPRE: Aaron is not necessarily wrong and everyone is speculating. To correct you just a little bit, yes the PATH act was “signed” in 2015 but it wasn’t to go into affect until this tax year – it was signed on December 18th of 2015: my proof is here :https://www.irs.gov/uac/newsroom/path-act-tax-related-provisions so he’s not wrong and people are going crazy this year with fabricated rumors ,speculation and the name calling and calling people out has been terrible this year. Everyone needs to chill and just respect everyone here

Aaron is abhorently wrong.
The path act was signed and began in 2015, this means my tax refund shouldve been delayed last year, it was not, it was back fairly fast, there is no way they are holding millions of tax refunds until the 15th period, the system can not handle all those refunds (as we saw 2 years ago)
if you were able to get both your transcripts then your dd will be coming, naysayers every year state it has nothing to do with your dd, but they are always wrong, period.

I keep trying to order my transcripts and it says info does not match their records. None of my info has changed for years. And i know I ordered them last year but can not remember if it done the same thing. I have only tried through mail not online. Is anyone elses doing this.

January 26, 2017 at 12:18 pm #4153094Bridgette
No you will not. I have both credits and received the path act message and to check back after 2/15 for personal updates
-
January 26, 2017 at 11:32 am #4153067Aaron S
Probably not. The path act specifically prohibits the IRS from issuing refunds for anyone who Claimed EITC or ACTC prior to Feb. 15th. Of course I am no expert, but I doubt we will see anything before the 15th.
