I worked at a restaurant last year as a server
They gave me a 1099 when i was clearly an employee. This is a new restaurant (opened in March) so they were giving me personal checks in the name of the restaurant. I did fill out a w9 which i NOW KNOW comes with a 1099 but i did not know this as it was my first job. Also I guess taxes were not being held but again I never paid attention to this.

Does anyone know what I can do ?
      (Also i have 3 daughters under 7)

All I know is a 1099 is usually when you are in buisness for yourself! Hope this helps! Sounds like they done you wrong!
