I file an injured spouse form with my joint taxes every year so my part of return is not applied to my husband’s past due child support. Will I receive part, or all, of my stimulus check with the form being filed with my taxes? Do I need to file it again?

I am in TX and have back CS but we filed IS for the last several years. We received exactly half of the expected stimulus for us and 3 kids via direct deposit. Honestly what I expected, although in fairness I think they should have only taken my $1200 and not any of the kids portion. Still have not received any update via transcripts for IS filed around Feb 15 but at least we were able to pay the mortgage this month.

I wish I knew the answer I am an injured spouse and file the IS form for 2018 & 2019 got my refunds for those years but they took the entire stimulus so yes they are taking it all but I don’t know if and how to fill it out for stimulus. I mean just directions on the form are tax year and income specific.

I live in a community property state, filed injured spouse for 2019, IRS has not processEd, and offset phone line said 2 offsets equal to economic impact payment ($3,400) will go to CS on 4/15

There is an IRS SAMS (Systemic Advocacy Management Submission) pending for this issue. For anyone else that submits a SAMS request, use issue number 42478.

DO not call the Advocate office… They will delay it even more. Just wait and be patient. Im in the same boat but, life goes on. You will actually thank God when you finally get the money. Just know your blessed and God’s there for you!
