Received the dreaded 420 audit code and just got the cp75 letter for dependents. Anyone else gotten this and what was the process and wait time?

@Brend b: Without an advocate, it could take around 4 to 5 months. They work on audits in order of received.

@Sheila_33: I have 2 971’s dated for may 12th. Lol, I didn’t start getting IRS correspondence letter until my TA got involved. They were sending me letters instead of my TA which is dumb lol. Just got another letter in the mail today from them. So we will see what that says.

In your case, they are giving the other party time to prove thier claim as well, and they have 60 days to do it, plus review any documentation that she may have provided. If she cant prove that she supported them for more than 6 mos of the year, than she cant claim any credits. ( along with your court order, anything that has the kids names on them in a legal letter head provided by daycare, school, or dr’s office with your address is proof to allow you all credits and deductions)

Absolutely!, Mine was stuck on April 02 until late Friday. Any new codes posted for you yet?
they cant let your file sit to long without updating it and asking whats going on with it in the examination department, so Ive been told. Have you heard anything from the IRS or from your TA yet? Keep in mind, like with my situation, if someone else claims your dependents, they pull both returns for examinations. Then both parties have to prove that they are entitled to the claims and deductions. The party that cant, has to repay the IRS immediately and with interest. They will review all of your documents and verify everything, which can take up to 60 days; then they do the same for the other filer. With a tax advocate, it only takes a couple of days once the IRS starts the examination process.

Oh well. At least you’ll hopefully see something pretty soon. I hardly get on the site anymore, just to check if a few of the regulars finally got their refunds. On the good side of it, I know a hell of a lot more about audits than I ever wanted to.

The crazy thing is, now they are going to audit your dependents paternal grandmother and if she can’t prove proof, she is sol

Thats good news atleast, I wasn’t listed as the father on one of my children’s birth certificates nor the custodial parent so they disallowed one credit of the credits for that child until I send in a copy of the child’s birth certificate with the corrected information. Other than that, my audit is complete and I “Should” have my refund in 2-3 weeks. albeit the amount is was less than I was hoping for.

The tax advocate told me that there may be a problem with someone else trying to claim the kids on their return. My guess would be their paternal grandmother, since she has all their info. She also told me that I have sent everything in I need for verification on their being mine but the audit dept is extremely backed up and since I honestly told her I was not suffering any hardship I may end up having to wait for a bit. I pretty much have resigned myself to the fact that it is possibly going to take longer but would just like it to be done with

Nope, nothing yet, had to submit more documents. I didn’t sign my daughters birth certificate 4 years ago because I was deployed and that came into question. So I had to submit paperwork showing the she is mine, which is dumb. Anyways, that was all done today, and they also asked for more supporting documents like electric bills and what not… this is ridiculous, but I’m glad to be going trough it, because, next year, if they pull their crap, Im going to file with a paper return and attach all the documents in the mail, along with my tax return. :)

I’m supposed to get assigned an advocate today after waiting a week for any contact. Was hoping to see you had updated to more positive news.

Heard back from TA today, now they want proof that my children live with me and I now have to gather paperwork showing that they live with me. The ones that are of age to be in school, will get a note drafted for them. As for the younger kids that aren’t of school age, the need a letter from a medical provider with dates seen and address listed.

They want to make sure that all my dependents are US citizens and that they are under the age of 18. Lmao so since my step son last name is Martinez, they think he’s an illegal alien? Gtfoh lmao. Omg. She said she already had internal documents, and that she was going to send those over today. If she has an update by the 26th, she will let me know if they released it or not. At this point, they are not concerned with the amount of interest from my mortgage company. It’s about time something happen

And they were dailys so maybe our time is coming. So you have literally stuck at a 3/5 as of date for the last few weeks? Mine would update to a 3/12 and then go right back to the 3/5, then 3/19 and right back to the 3/5, and then 3/26 and then right back. I would really like to get off the damn 3/5.

Called today at lunch and left another message, he called right back to let me know that the IRS accepted my documents as proof and have approved my refund, no adjustments were made.

This is a big relief because in 2016 I was granted guardianship of a relative. I was concerned that somehow, someway that I misinterpreted the definition of foster child (any minor placed with you by a court). I was also concerned I didn’t send in enough proof that I took care of him through the year (clothes, grocery receipts, etc.) Who keeps all of those receipts through the year? Well I do now!!! I have a big shoe box I started collecting all receipts in. No receipt gets thrown away at my house lol.

I am so relieved this is over and I can move on. Good luck to the rest of you and I hope next tax year goes smoother.

No major update yet. I called my advocate on Wednesday, left a message and never heard back. I will be calling again Monday. It is now over a week past the deadline the advocate established for the IRS to determine if they need anything else or release the funds.

There was one thing that changed on my transcript. Under my name/address where it shows account balance, accrued interest, penalty, etc. To the right of that where it says the ‘as of date’, it changed from 3/5/18 to 3/19/18. I wonder what that date means, and why it changed.

Also, do you know when they finally release the refund, is it still direct deposit or do they send a paper check? I hope they don’t send a check.

                                                                      • #4231992 Reply

Still nothing for me but I really don’t expect anything just yet. Advocate said 2 to 3 weeks. And I’m not one to keep calling. Trying to focus on other things. Thinking I’m going to paint my house lol. And I am tryng to get my mustang started. It has sat for 6 months and I can’t get the key to turn in the ignition. Anyway, let me know if you guys see any change. Luckily we can see our transcripts so that is a big plus.

Still no changes here. I check my transcript at least twice a day hoping to see some good news. I’m going to call my advocate tomorrow since the deadline he gave them was last Friday and still no movement. I was nervous all day today because the daily USPS email showed I was getting a letter from the IRS. Turns out it was just a notice I signed up with them online to check transcripts.

As far as processing time I have seen anywhere from 2 weeks to 12 weeks. Lets all hope since its early in the year they will resolve these and move on to the real crooks.

Verifying the same dependents I’ve carried for the last 5yrs which are my children by the way! My tax advocate said that everything looked good and she faxed it over to the IRS. My question is how long does this audit process take?

Yeah, there’s nothing to appeal, it’s still under review. Is this a generic message they throw up, because it sure doesn’t apply to me yet. I’m waiting on them to review the documents I sent in and release the rest. I’ll be checking my transcripts daily to see if anything changes.

I have a DDD for the non actc credit for the 22nd with an 846. They are holding the rest from the actc and that has a processing date of 03/05, so March 5th. I haven’t received a notice or a 971 TC. They should at least tell me if I’m being audited or send out a letter. I filed on the 24 and accepted on the 26 of Jan. It’s like, should I call and ask them what’s going on, or just wait… This is killing me.

@Sheila_33 So I faxed everything in to the IRS & my tax advocate on Tuesday. Then on Thursday I was reading online another case of someone involving a CP75 letter and how it took them over 500 days to resolve it. I started panicking and went through all 12 months of my bank statements and blacked out everything except what could prove that I’m HOH and provide for my dependent. I showed them each month where my mortgage came out of my bank, my utilities were paid, groceries bought. I think I went above and beyond to prove my case here, but I didn’t want them to come back and say that I didn’t prove I actually paid for those items like they did in the story I read online. In that case, the person used money orders to pay her rent. The IRS wouldn’t accept them because they say anyone could have purchase those money orders. I wasn’t letting that happen to me! All-in-all, I faxed over about 55+ pages of documentation.

My tax advocate called me this morning. He is very nice and eager to help me get this resolved. I asked if they are holding my entire refund or just the portions in question as the letter stated. He believes they will hold my entire refund until the audit is complete. The good news is he is forwarding everything I sent him to the IRS and giving them 1 week to review and release the refund – OR – decide if they need any further documentation from me. I really hope that they now have everything that they need now and approve it.

My status changed on the ‘Where’s My Refund’ page from the tax topic 152 to ‘Your refund is being processed’ message that everyone else has too. No mention of audit or any troubles, so that’s interesting!

If you’re not seeing that 971 maybe they internally fixed things. I know there is going to be no change on mine tomorrow because I just got everything faxed in yesterday.

Looks like there are going to be a lot of us in this boat. So far I have counted 10. I have had that audit code for 2 weeks and was ready for that letter. I was happy that it was just the cp75

I got my case number and my actual advocate will contact me in 3 days. I’m pretty hopeful that this can be a quick(ish) fix. I mean really, all anyone there has to do is spend 15 minutes reviewing my documents and they will see I qualify for everything I filed for. But getting to that point is the challenge!

I received my CP75 letter dated 2/12 on 2/10. I gathered all documents requested and faxed this morning. No idea how long this is supposed to take. I have to prove HOH status eligibility also, plus dependent. They want grocery receipts for the year (who keeps those?!?) purchases of clothing for the dependent, doctor visit receipts, school records, utility payments, mortgage receipts, everything. Well I blasted them with a 43 page fax that proves everything, so they better be on it.

I also filled out the form for a tax advocate because the uncertainty of when they’ll get to me qualifies me for a hardship case in my opinion. What I’m confused about is the wording where it says they are holding the part that has the earned income credit. They don’t mention if they’ll release my normal tax refund without claiming the other stuff. I have no idea what is happening or how long this is.
