Child Support Offset Reqs? If its on the Offset line, will I 100% get Offset?

    So, I called the Offset line and it says that they “MAY” Offset but it doesn’t give me an amount or anything, just a number for the State of Oregon: Support Enforcement Division and to call them to see if it will be (I cannot get a straight answer from anybody). Basically, last year I had court with my ex for our official divorce (we had been separated 2 years prior), where the judge ordered me to pay half of the child care for the last few months (no actual child support for basic needs because we split 50/50) that she had been paying and half of it from here on out and so it went retroactive and I owed money. Well, I have been paying on it out of every check, and I still owe $300 bucks. I am assuming this is what the Offset line is talking about since I only have 1 child and 1 case with support enforcement for the amount owed from those months..

    So I am kind of in a bind wondering if they are actually going to or not???
    When I call the offset line it says it “MAY” be offset, but EVERYWHERE I have looked online says that the requirements for Federal Offset are that:

    A.) She is on TANF and I owe the State for Child Support (which she is not) or;
    B.) I owe her personally more than $500 in past due support (which I don’t)

    So to me it would seem that it doesn’t meet the requirements for Federal Refund Offset??
    It would be nice to know, so I know what to expect and how much I am getting.. 300 bucks is 300 bucks. Especially, when I feel I shouldn’t be paying it since in mediation she agreed to pay the full amount each month because I had him 5 days a week and had been paying ALL of his expenses in full the 2 years prior to this.. But 6 mos. later in court she went back on it and played helpless, so now I am here.. SO, my fingers are crossed and I am hoping that it doesn’t Offset..

    Does anybody know anything about this situation? Does everything that the Offset Line says “MAY” Offset get FOR SURE, 100% Offset? Thanks.

    Unfortunately, yes.. If you call the # and have an offset listed I would definitely expect them to offset.. Sorry.

    first off, good luck getting the division of child support in Oregon to listen. At all. I’m lucky they are ONLY coming after me for back child support at this point….it’s sucks man.

    Your worker at the DCS will pretty much tell you the same as me. It’s automated via a computer. Yes. Your refund is getting offset by however much you owe. Example: I am able to claim my son this year so I did and still owe back child support so 325 is getting taken. Pretty much ASSUME your back child support amount is going to get taken just like it does out of your check and do a little dance if it doesn’t.

    I wish I had better news man.
