Just wanted to make a topic for people to go to when they have been put under review and share their experiences.
Filed 1/12 HRB online. Accepted 1/30. I was processing 1/30,1/31, and 2/1 and finally updated to this:
We have received your tax return and it is being reviewed. You will receive a notice from us requesting additional information within 30 calendar days. You may not receive all or part of your refund until we receive and review the information we requested. If you need more information after you receive our notice, call the number on the notice.
Please do not contact us until you have received the notice as we are unable to take any action until then.

Okay to fix what I said previously. I got my letter today. Code CP75 tax year 2012 notice date February 18, 2013. It states: we’re auditing your 2012 form 1040A. We need us to send you information to support items you claimed on your tax return. We are holding the Earned Income Credit (EIC) and/or the Additional Child Tax Credit (ACTC) portion(s) of your refund pending the results of the audit. Be sure to respond within 30 days from the date of this notice or we’ll disallow the item being audited, and you may owe additional tax.
Then it gives me a bunch of info on what I need for proof. Nothing has changed in the past few year which before that the only thing is a change of address 3 years ago. I just want this to be over and want my money but it looks like its going to be a while. Ugh!February 15, 2013 at 5:57 pm #8483
I have still received no letter. I have been told I am in review but not what for, and wmr showing still processing with topic 152. I filed on the 30th. I think things will start looking up for a lot of us this next week I think the irs is just behind….a girl I work with said wmr TOLD her she was in review last year…she never called the irs or recieved a letter. 3 weeks later she had her refund.
I still got an advocate and sent her everything I needed to her today. (I assumed that would be the same information another poster on here was advised to send to their advocate…so I went ahead and sent it all to her even though we have never actually spoke I just missed her call yesterday and called her back and got her fax # from her vm.)

And it tells me a whole bunch of information on what I need to send them . This is a bunch of b******* nothing has changed for the past few years. UPDATE:** Just got off the phone with a tax advocate… They said that the irs has 45 days from the date the letter was SENT to get you your return and that the IRS is sending a LOT of these letters out this year (CPO5) cause they are backed up and they are buying time to catch up… He also said that he has seen them sent in 30 days from the date… He looked into my return and said there is NOTHING wrong (no red flag, no back taxes, no problem)… To all of you that are fed up with the bitchy rude reps that wont answer questions or even open your file then just call the advocate and they will take care of you, ease your mind, and be polite doing it… Heres the number 1(877)-777-4778February 15, 2013 at 4:50 pm #8478

@HollyD- same exact letter also!!! Im almost positive that its the goverments way to drag thier feet since theyd rather give all our money the 3rd world countries and countries were at war with.. Mail just came. There was a letter from the IRS it is a CP05 dated Feb 25.
Says “Our review will be completed by April 11, 2013.

I really don’t think there is aletter…we got flagged for filing early–even though itwas my tax softwares fault for sending it in early..

Ok so i made a final call, one last try…i just asked to find out about my 2012 return..
she said u have to wait 21 days from when u filed…she asked when that was
she was shocked when i told her the 25th…21 days today..
she quickly changed to astory saying the irs site is down and they can’t look anything up until 21 days from the 30th…she pauses and comes back to tell me thats wednesday..
I told her i just wanted to make sure nothing was wrong..she said she understood, but she could only see what date it was accepted and thats it..
the first call i madeshe gave me a little more info..this lady never took my information..
30 mins wasted again..thatslike a total of 4 hours +..

Styx, I was just able to order a transcript. Accepted on 1/27 and Processing ever since.
I called previously and was told I wasn’t under review and they saw no problems.. Just unlucky in the Processing Lottery, so to speak.

well today is day 11 and still havn’t got them in the mail..so i called- strickly based on that ?..She was a bit*H, told me i never past the test to get transcripts and that i could not order them then or now because i’m still processing..

accepted 26th..started to worry 4th..ordered transcripts-ok..
5th i called..told me i was all done but for some reason my return was being held..’
6th-12..called afeew times got a whole lot of differnt answers..
ID theft, missing a Tax form in my return, to my dependants might be a red flag ( same this is year 4, excact same)..
12th, WMR changed to STILL processing, refund when avaiable..sounded good…still nothing..
Tomorrow is my 21 day mark..I really want to call again but i know they wont e able tohelp me..

My WMR has changed for the first time since the 31st to the A refund date will be provided when available message. Called Holds Department….”We see no holds or anything on your refund, its just processing”
Called Examination Department….”We see it is under review but we have no idea why and it shows nothing that indicates it will come to our department. They might just look at it and see that you filed the same way for 6 years and just release it”
Called Tax Advocate….”Yes, we see its under review..we’ll start a case for you” Waiting to hear back

Have you tried calling the transcript phone number? I know on the online transcript I kept getting that information but when I took out the “.” and “,” in the address I was typing it worked. I do believe your theory personally that they are holding larger refunds in some cases for the maximum 21 days. My refund is over $8k same as last year (which I received in about 10-14 days in 2012). I was accepted on 25th but IRS says accepted on 1/28 and my status just changed to “Processing date will be given when available” for the first time this week I believe on Monday morning. I finally was able to order a return transcript this morning where I was not able to last night. I have talked to examinations department as recently as yesterday, hold department, have a tax advocate and no one sees my letter 4464c in the system or says I am in review. The letter is dated 2/1 and I don’t mention it in the beginning. I have had times when I asked them to go over my account.. no debt indicators, no flags, no holds, just processing. I then ask why letter 4464c then I get put on hold and some have asked me as of yesterday in examination department to read the letter to them which I find funny since it is their letter.February 15, 2013 at 7:42 am #8398

One thing that I haven’t seen from anyone is this: I began to check WMR about 30 minutes later & was showing up! I received email from TT that my return was accepted, so I went back to WMR and the orange bar was on approved!!! I said to myself, “Dang, they are moving fast as h3ll this year. I might have a DD in the morning.”!! It stayed that way until the following day sometime, but that night it was back to the first bar…accepted. I checked the mail on the 6th & there was the IRS letter dated 2/4/13. My WMR has stayed the same besides the times I get locked out & nothing populates for me. I got the reference code 9001 last Friday and called and was told my tax return was under review. I wasn’t able to order an account or tax transcript with my new address either. They told me to wait 60 days and I received the 4464c in mail. I just checked the transcript hotline and was able to order an account transcript with my new address. Ok here’s my processing review story from hell…. Filed 1/17, accepted early on 1/24…. Started checking wmr on 1/30 said processing, allow 21 days. Starting 2/5 when I saw other people getting there deposits that filed after me I started calling IRS. Spoke with a different rep each day for 4 days, all looked up my acct and told me everything was fine and I was just processing… On 2/9 I called the tax advocate line and was told the same b.s. about processing and allow 21 days.. On the 10th I recieved a letter in the mail dated 2/1 stating I was under review and to wait 60 days and they will send me another letter if they need any additional info… So meanwhile I talked to 4 different reps and told everything was fine and i was just processing but in all reality I was already under review with a letter in the mail … So I am behind on my rent this month from losing my job and called the tax advocate line. They filed a case for me and assigned a tax advocate for me on Tuesday and told me that by Thursday I would recieve a call from my tax advocate. The next day I recieved a call from the rep , which was yesterday, and she informed me that in order to try to hurry any process along, she needed me to fax her my proof of hardship, my w2s and last three pays tubs for each w2. I faxed her everything today and she called me an hour later to confirm receiving it and told me she will have the proof submitted to IRS and find out what else they need but even with a tax advocate, the IRS still has up to 3 weeks to complete your case. So at least there is a little relief knowing that it can only be anther 3 weeks… As far as wmr, since 1/30 wmr, hotline and app have all shown processing with 21 days message. On 2/12 I was able to order both transcripts and status changed to still processing, date will be given when available…. But I know I’m still in review. Okay so just to update my info.. Filed 2/17 accepted 2/25 I was getting the 21 day message on WMR then on the 2nd it changed to Take Action your return is under review. IRS2go gives no reference code but same message. I received a partial refund ( for the federal portion of return) on Feb 5 just before 3 p.m. CST. I got an E-mail from Turbo Tax AFTER I received those funds telling me they will be available 2 days later. So far no letter in the mail and updates. Now obviously the IRS and the companies we filed through aren’t on the same page BUT anyone who used Turbo Tax is your status showing that you will receive your refund by 2/18?February 14, 2013 at 5:22 pm #8345
My bar never disappeared nor did the message ever change prior to the ddd. It went straight from the original 1 bar and processing 21 day message to a ddd. I’m just trying not to get my hopes up or anything because until my refund is in my account I’m not going to count on anything.
So like a lot of people have suggested or straight out said I too wonder if the people answering our calls at the good ol IRS are not tellin us stuff just to get off the phone or reading off a script.
Oh and also on 2/13 when I got the ddd I first checked the irs2go app on my phone & it showed but when I checked wmr right after it showed still processing and didn’t change until later in the day but the app and hotline said the ddd.February 14, 2013 at 4:54 pm #8343

Well I don’t know if this is much help or not but I will share my story. I filed on 1/29/13 and got an email saying I was accepted on 1/31/13. Wmr stayed on first bar and that I was still processing 21 days thing. I requested transcripts on 2/5 (trying to take out a loan but needed as much income info as possible due to self employment) & was only able to get account transcript. I claimed hoh, 1 reg w2, schedule c (no self employment deductions just the income),& 2 kids (my 9 year old & new baby).
I called 2 different times and was told everything was fine just still processing and that nobody is able to order transcripts of any kind for 2012 because they are not ready (I knew better than that because my boyfriend ordered both his 2/5 and got a ddd on 2/6 for 2/8). On Monday 2/11 I our thranscripts came in his were 2012 so the IRS is just saying the transcripts are not available but my acct transcripts said there was not a 2012 tax return filed. So I freaked and called irs again but called the number on the transcript for if there were any questions. The lady I spoke with said my return was there and the same spill about transcripts being unavailable but proceeded to tell me that my return was being delayed by 1 extra week. I asked why and she said because of the high volume of returns and that I was put into review but if they needed anything they would let me know just to keep checking and could take 4 weeks.
Just out of hopes I tried for the return transcript again and nothing but tried again later that night around 10 cst and was able to order it. Yesterday 2/13 I did get a ddd for 2/15 so I am in hopes it will be in my bank tomorrow but still trying to figure out why the last lady told me I was in review.

@whitneyf 1242 is a “reserved” delay code. The IRS does not publicize the reason behind it. There are many possible reasons but the EIC seems to be a very common area. If you’ve claimed the EIC and there is anything questionable about the claim your refund will be delayed while the IRS investigates it.

The IRS today alerted taxpayers and the tax community it is experiencing high traffic on Where’s My Refund as more tax returns come in. The heavy volume of refund inquiries means that the IRS anticipates both “Where’s My Refund?” on IRS.gov and the refund feature on the IRS2go phone app will have limited availability during busier periods.
Due to the large number of inquiries and to avoid service disruptions, the IRS strongly urges taxpayers to only check on their refunds once a day. IRS systems are only updated once a day, usually overnight, and the same information is available whether on the internet, IRS2go smartphone app or on IRS toll-free lines. While “Where’s My Refund” is updated nightly, your account will not change that frequently.
The IRS is seeing a good start to the filing season, and tax refunds are being issued timely. Nine out of 10 taxpayers typically receive refunds in less than 21 days when they use e-file with direct deposit.
The IRS expects to see the number of tax returns — and related refund inquiries –steadily increase around the President’s Day holiday week.
Here are some tips to help taxpayers with their refund questions:
∙ Have the right tax information ready before using any of the IRS refund tools. This includes Social Security number, filing status and refund amount.
∙ You don’t need to check Where’s My Refund more than once a day as your information will not change.
∙ To avoid system delays, the best time to check on refunds is evening and weekends.

no change for me today… still receiving the direct deposit date will be given when available and no bars which happened on Monday morning. Just processing… I talked to someone again at the Boston office of Examinations and she said she could not find anything in the examinations department at least on the screens she reviewed. I still can’t order a return transcript, and wmr still says I’m processing. I have not gotten a letter yet, and all the irs told me last week was that I’m under review, but only for 7 more days. Today would be the last day. I have tried to call this week, and was given the “no one can see your return until 21 days have passed” crap. I filed in jan. got accepted on the 30 went under review on the 2nd and said to take action and a letter would be on the way asking for more info.I’ve been calling the irs and everybody tells me something different but the same thing LOL we don’t know wait for the letter some say the letter is asking for something but they don’t know what and others say the letter is just telling me I went under review and they might need more info so I checked wheres my refund and it changed to under review again but it says nothing about a letter and says for more info call 1800-829-0582 and give them the ref.#1242 so I call and they tell me the same thing I was told on the 2nd.Wait for a letter that may or may not ask for something.smhFebruary 14, 2013 at 10:04 am #8281
I am so sorry you are having to deal with this like the rest of us. No one deserves to lose their home. I know, I’ve been there and now my family and I are having to live with my mom after losing our home. As far as the tax advocate goes, the people I have talked to that haven gotten help from them have just explained that not having the refund is causing great financial hardship. Maybe if you said that and left out the part about your house, they might be more willing to help you. Crazy that they want proof from the people who need it most but a fair share of folks are just calling and straight out lying or exaggerating way beyond whats real.
I really hope you get the answers you need, and soon. The IRS is just playing games this year and none of it makes any kind of sense. For what its worth, I don’t think you are *really* in review. From what I have read here and on other boards, everything is just all screwed up. It doesn’t make any kind of sense that ALL these people are in review. We can’t all look like liars and theives. Same thing, I filed 1/24th, accepted on 1/27th. To make a long story short. The first IRS rep told me nothing was wrong. WMR and IRS2Go both said processing with no code. Never got a letter. The holds department told me everything was fine, the examination department told me they saw it was under review but there was nothing indicating why it was under review nor nothing indicating it would come to that department. She said it was more than likely my depedent. She said they could ask for more information or they could just notice that I have filed the same way for six years and release it from review.

Ok so after reading in the forum about reviews this is what I’m coming up with because the IRS is no help!!!

Knew something was wronge seeing as how my brother I law filed last week and received his today!!!
Called and spoke with a very nice lady. She told me my refund had been aproved but had a he on it. So she transferred me to the holds department and from their I was told they didn’t see anything! Was transferred back to customer service and hung up on. Called back this time straight to the holds department.. The lady I spoke with was really short with me. She stated my refund amount and that it had a hold she wouldn’t tell me why just that I should be receiving a 4464c letter then hung up on me! So I called the tax advocate line and I’m not afraid to say why! ( 4 months behind on mortgage )
Was told unless we recieve a letter saying our home will be foreclosed on they can’t help:’(
She did tell me that my 4464c letter hasn’t been sent out yet (they send them out in batches)
After doing some research I do believe our refund is being held be quad of the amount +9k the largest it’s ever been because my husbands work was slow this year. Which is the reason we are behind on our house but also the reason for the larger refund (different tax bracket)

I just saw something interesting on the IRS website, for those of us tha have received a letter (4464c). I’ve looked at this 3 or 4 times trying to understand it/why/where the **** my refund is.
Anyway, down at the bottom it shows an example of the CP05 letter that some of us got. If you look closely at the example, it looks a lot different from the one that I received (and yours is prob the same as mine) For one, mine certainly doesn’t say “We are holding your refund until we are finished reviewing your tax return.” And in the notes it says yours make look different because each letter is tailored to the individual. There is nothing “tailored” about my letter. It says my, name and SSN at the top, but from there down, its the same as everyone elses.
I’m just trying to prove the thought that this very well may have been a glitch that gave us all these letters. I may be grasping at straws, but with so much horrible speculation going on I’m just going crazy over here.February 13, 2013 at 3:42 pm #8192

@ashleymt I agree. I have not received a letter to date. I have googled this a million times, and all I can come up with are people talking about a “glitch” with the early filers, and many people received letters, but they were basic form letters, no reference codes, nothing.
I know I have not done anything wrong…same return as the last 10 yrs at least. HOH, 2 dep, EIC, CTC, Sch C along with a small W2 from a weekend job…I made about 200.00 more this year total than last year, my refund is 140.00 more than last year.

I don’t know what to think….I want to believe this thing is going to sort itself out in the next couple weeks MAXIMUM but I know that’s pretty unrealistic. I work with a girl that said she was ‘reviewed’ last year and she said she never had to send anything in and that she got her return 3 weeks after she found out she was in review. I REALLY wish we had more people on here that have been through this and could offer advice. I am a huge googler and this has been pretty hard to research. I filed and was accepted the 30th. Same return I have filed for years. I have been stuck in processing purgatory since the 30th. I finally broke down and called last week, and was told I was being reviewed, and I would only be put behind a week, and if I didn’t hear anything, to call and make an application with the taxpayer advocate. I ordered an account transcript on the 5th. I received that Saturday. It says the processing date is the 18th, and that I have not filed a return for the tax year of 2012. So I call…I need some sort of proof of filing for my divorce, and this wasn’t going to cut it. So I call, and was told that MOST people who filed in the very beginning were re-sequenced to the 7th, and if WMR says I’m processing, then “by golly” I’m processing.
So, as per the IRS rep’s instruction, I call again, to the taxpayer advocate line. I tell them what I was told. Ms. Francis told me that NO ONE at the IRS can look up anyone’s account before the 21 days is over, and no, she can’t confirm if I was accepted the 30th or the 7th, because 21 days has not passed.

Although that’s pretty silly since I didn’t have that issue when my first 2 kids were born. I really believe that the reason that so many are under review is because of the new fraud software programs. If you filed early and especially if you filed early with dependents then you were automatically flagged for review instead of randomly selected. Instead of acknowledging the glitch and doing something about it the IRS is just acting like they were, in fact, legitmate flags.
They told me that it could be a long process also. I think this is ridiculus. I bet 99% of us under review have filed the same way for years and are most certainly not tax frauds. Once again regular people get the boot trying to catch criminals.February 13, 2013 at 2:11 pm #8184
I talked to the examination department too. You can be in review under different departments for different things and examination is just one department. Mine is being held for review in a unknown department to everyone I have talked to. The last guy I talked to said sometimes they hold them back for review and then later decide they don’t need to actually review it and release the refund. He also said they may or may not need additional information from me to confirm what I have on my tax return. He said that the people that are held for review are sent letters in batches, and sometimes it can take a while to get a letter. He saw that I already have an application in with the tax advocates for an expedited return and said that was a smart move on my part…that they can help me figure out what is going on with my return etc. etc. until the issue is resolved. Although he gave me hope about having my review be released, he also said that depending on any information they might request from me to verify that it can become a very lengthy process….as in months. I don’t know what to think. I have 3 dependents (all mine) and eic. That;s it. One w2. Looking forward to keeping in touch with everyone on here and getting some support through the process. I called the Examination department and they told me the kinda the same thing. It was NOT showing in her department, did NOT show anything that would make it come to her department. So she did not know why it was in review. However the difference was she told me that she COULD see that it was in review. She did not know why I didnt get a letter or a code. She theorized that it was because of my dependant. She told me that it could take 30 days to resovle and that they may ask for more information. On the other hand she said they might just look at the fact that I’ve filed the exact same way for the last six years and release without a letter or ever asking for more information. Another update: I just called the Examination department which is the department she said the return would come to if it is being reviewed. Same here. I filed and was accepted 01/30/13. My update on WMR and the hotline has been the constant 21 days processing and hasn’t changed. This past Saturday, I received the 4464c letter with a 0 code on it. You would think if you are actually under review they would put that on the WMR site or on the IRS hotline. I don’t know though. I REALLY want to know if I’m really under review, if its just a glitch, if its just a form letter sent to everyone that has EIC or dependents or whatever. This sucks! Worst tax season EVER.

I really think this new fraud system automatically flagged everyone that filed early for a review. I’ve file the same way with the same information for 6 years. They should just realase those now that the education credits are starting to process today, that’s just going to clog up the system even more. I have this sinking feeling that those of us under review are going to have to wait till the end of the tax season before we get anything. Well I called the holds department and acted as if I just wanted to know the status of the return. He looked through the return and he said everything looks totally fine, no holds, no flags, etc just processing. Said they are overwhelmed with returns right now and possible could go past 21 days but I was accepted on 28th so 21st day would be 18th. I never mentioned the letter to see if the system showed anything and he said he saw nothing wrong with the return and the processing of it. I asked if the 21 days message dissapearing and the your return is processing is a good sign and he verified it was a good change in status update. SMH I don’t know what to believe or maybe the review could be over? Let’s just try to keep each other updated the best we can even though we all have different situations we do however have one thing is common in that we have been told we are in review or received a CP05 letter or in my case a 4464c letter.February 13, 2013 at 8:39 am #8125

I have been on the phone with the irs pretty much for the majority of the lsat 2 days. I filed on the 17th, accepted the 30th, and been in processing hell ever since. No letter or anything. I talked to multiple people, some told me I was fine, others told me there was some mysterious ‘hold’ on my refund. Finally a lady today told me I am being reviewed, she said nothing about having a letter being sent at all, and said to wait up to 60 days from today for anything to happen and that the irs is just checking out the information on my refund. (hoh, 3 dependents, same everything as last year). I spoke to an advocate today that put in an application for me to have my return expedited because of financial hardship. (I won’t go into the hairy details but there is financial hardship I assure you)…Looking for help and hope, anything to keep me going. I don’t know whether to call back tomorrow to see if there are any new developments or to just try and forget about all this for a couple weeks. (as if that’s even possible!) Please guys, ANYTHING! I agree with you also Matthew and Trob… this is confusing and I find it funny the 2 times I called asked generic questions.. 0 debt indicators, 0 flags, no holds, everything is processing fine… I then say well why did I receive a 4464c letter… hold on please sir… then they come back with something. They should be able to inform me if I am really under review. I should not be informing them. How else can you explain the reps telling me every time I call there is nothing wrong its still processing, blah blah WMR is correct until I tell them that a rep last week told me I was under review. Then they say, oh, ok, I see the letter was mailed out give it 45 days. What, they couldn’t see it before? After 2 weeks i changed from one orange bar processing give it 21 days to.
ur refund is still being processed, date when availiable. no orange bar….

I just got off the phone with a person from the IRS (Called and put in Ext. 362). Was on hold for about 20 minutes but got a live person.
She went through everything on my return and my account.. My 2012 return isn’t in the errors department or under review. It is still processing. She stated that they are having a lot of computer problems and it could be right at the full 21 days (which She stated started on 1/30 in my case) or possibly even a slight delay of up to one week after that to get my refund.
She went through my account thoroughly.. No offsets, no issues from prior years tax filings, my 2012 return is pretty basic.
She stated that I was one of the unlucky ones who filed early, began processing on January 30th, did nothing wrong, but are just having to wait longer than many others.
The main thing I took from this call was that we are in a state of limbo, as I’ve read mentioned before. It was good to hear that I wasn’t being reviewed or had made any errors, though it is comical that I may not get my refund until after some who may be in those situations.

My status finally changed to something different… WRM can’t find me … guess locked out even though I have not been in the system this morning.. and my status on hotline changed from the 21 days jargon to Your return is being processed and I will have a date when it is available. Every year i claim my girlfrien as a dependant..never a problem..
i messed up this year kinda..she worked 1500$..so thats why I have the child tax credit for in my return..that sucks..so sure this is my problem..
i did my same return under another name-strickly for numbber purposes-my refund would hsave been excatly the same without my girlfriend as my dependant, and i would have had my money a week ago.

I have same everything from last yearas this year on my taxes..
Last year i didn’t have the 8812 form because i guess i don’t quifily for child tax credits..
this year i have the form in my return, but its not filled out, only the bottom which is the addiotional tax credits..
here’s a thought..last year i had a seperate form for additional child tax credits..this year its one for and the questions for the top portion are not being answered..

So i just checked WMR and I have a new message “Your return is still being processed a refund date will be provided blah blah blah” Went and tried to order my return transcripts and it went through…here’s hoping for a DDD soon…I will keep everyone posted and as always I ask that you do the same. Ok I think I found the problem, read this i copied it, look at your child tax credit form 8812, In part one you have 4 boxes a b c and d. There should be a x on yes or no on all 4, if yours are blank thats the problem,
Subject: Schedule 8812, Child Tax Credit Attached to Form 1040 or Form 1040A ________________________________________ We have observed instances in which the Schedule 8812 is attached to form 1040 and 1040A and is not filled out correctly. These instances are causing downstream processing delays. We have experienced the following two conditions: (1) The Schedule 8812 Part 1 checkboxes A, B, C, and D are checked when taxpayers list a dependent child with an SSN qualifying for child tax credit and (2) The Schedule 8812 Part 1 checkboxes A, B, C, and D not being checked when taxpayers have a child with an ITIN (Individual Taxpayer Identification Number) on Form 1040 and 1040A line 6c identified as qualifying for the child tax credit in column 4. The Schedule 8812 instructions direct the taxpayer to: “Use Part I of Schedule 8812 to document that any child for whom you entered an ITIN on Form 1040, line 6c; Form 1040A, line 6c; or Form 1040NR, line 7c; and for whom you also checked the box in column 4 of that line, is a resident of the United States because the child meets the substantial presence test and is not otherwise treated as a nonresident alien.” We are working to implement Business Rules to reject these incorrectly completed returns with a date to be determined. In the interim, we request that software packages include an alert to help preparers identify inconsistencies when completing the Schedule 8812 and that communication be provided to the practitioner community to avoid delays in processing returns. @fnr0420 …that’s all good news, but seems like it will only affect those with WMR status of “still processing” without any update. The main issue here is the vast number of filers with a status of “Under Review” with no discernable reasons, or even confirmation of an actual review. Are we affected by any crash or glitch? I found this on H&R block **************Ok this is my thought on the matter. Mine was sent to errors as well. I filed on 1/30 when the huge infux of people caused the system to crash.. they are doing a rebuild tonight on the MEF (Modernized E File) system. There were multiple errors caused because they had originally planned to have 2 schemas going to support 2 versions, however, they decided at the last minute to only use 1 schema. I don’t think a lot of the companies were prepared for that, and the software was not tested enough so anything that was sent before the 31st was automatically sent to errors because of the schema issue. They issued a tax alert Friday saying they have fixed the schema issue and it will go into effect on 2/11 (which is today).. Ok so guess this may be a good place to try and figure out what’s going on with my personal return.
I filed on 01/29 and accepted on 01/31 shows still processing should receive refund in 21 days with topic 152 (the one about direct deposit). I filed hoh 1 regular w-2, a schedule c self employment but no deductions or anything for the self employment and it was only for like 7500 I made from side work, and 2 dependents my 9 year old son and baby that was born this past June.
I called last week and was just told everything looked fine by two different reps at IRS but I called this afternoon and the rep (who was very nice) said that do to high volume of returns I was delayed by a week and that I had been flagged for review so instead of 3 weeks it would take 4 from when I filed. I asked about a notice Nd she said that they would contact me if they needed anything from me. She also said that as soon as info was available it would update to keep checking either the wmr site or hotline. I saw someone else post about having a new baby and being flagged for review as well. Does anyone know if maybe that maybe the issue is just the new dependent? She didn’t say just said review and delayed by 1 week.
Also I was able to order account transcripts but not return (I need them for a loan I have been trying to get and getting the runaround about because of the self employment).February 11, 2013 at 3:52 pm #7874
@kay…yeah, some good news, but still frustrating. Over the last 6 years, I’ve had to deal with this 3 times now, and usually didn’t get my return until June. If it’s not EIC eligibility, it’s Federal Ed Fund payments ($9.00 delayed a return for 3 months), or “we need time to double check the additional withholdings that we took from you to make sure that we don’t give you a cent extra back, ” or education credits, or Identity Theft “precautions.” What a ****ing mess.
Meanwhile, someone I know, that actually committed EIC fraud by claiming his friend’s 2 kids got his return in 9 days. Go figure.February 11, 2013 at 3:50 pm #7873

UPDATE: I contacted the Holds department this morning, and I was told that my refund is not on hold, but is in fact under review. Transferred again. They told me that part of my return has now been dated for DD on 2/13, but the rest would come “at a later date.” They said I would receive a letter, but no letter had yet been generated, so there is no code yet.
The nice lady on the phone was pretty helpful and said that a dependent had been “flagged.” Most likely since it was a child born last year, it affects the EIC status, and their system will not even attempt to automatically verify a relationship (my kid is less than 6 months old). Therefore I MAY receive a request for information, which would be birth certs, SSCs, etc. etc….but the bad news? She said that most likely it won’t get looked at for 45-60 days due to the volume. She didn’t say whether or not they were going to do this, but that it’s “up to the reviewer that it’s assigned to, and totally their discretion if they want to pull it or not.”
So essentially, they’re holding the EIC portion of the return, but she did say that my refund from the additional withholdings, would be released. Funny how the state of CA asks no questions about my kid, but the IRS “automatically” flags it. So frustrating.February 11, 2013 at 3:30 pm #7863

Called the 800-829-0922 number. The guy didn’t even want to look at my file, said if WMR says processing then that’s what it’s doing. I told him I know I have a hold, can you tell my why? So he looked it up, said a letter CP05 was mailed. That’s all he would say.
So I called the tax advocate line, told the lady that WMR says processing, some reps say I’m being reviewed, some say I’m not, hold dept says I’m not being held. Asked if she could help me so she says hold on I’ll get someone. I was on hold for 15 min and then a regular IRS rep come on the phone! She transferred me back to them!!
That rep said the CP05 letter was mailed on the 7th, I have to wait 45 BUSINESS days from the 7th to possibly have my refund released. If they need more info they will mail out another letter, and then the 45 days starts all over again from that date!

Just giving our info. My boyfriend saw the same “under review” status. Finally called the hold dept today (the # given here) and they said it was being reviewed by the exam unit. They gave a # that was disconnected to call them. Called back and was transferred to the exam unit. They told him that he would receive a letter explaining what paperwork he would need to submit within 30 days. He asked her what he was flagged for and they said for the EIC. He will receive the fed income tax paid in in a few days and the rest will be released once paperwork is in. Here is my story. I e-filed on the 25th was accepted in a test batch on the 27th. I remained in processing land from the 30th and remain there today. On Friday I received the 4464C letter. I filed HOH, 2 dependents both previously claimed. I was amazed when I found this page and saw that so many people have the same issue. I have been on Google since Friday researching and this has happened every tax year since 2010 from what I can find. What happens according to previous years posts is once you run through for the test the second run once the IRS opens flags your forms as a duplicate which generates the letter and throws you into the review pile. When you call the reps they usually are no help because your letter shows 0 as your error code. Which is a computer generated error.
