      I went to file my return, early, on Jan. 22nd, just to receive an email from H&R Block that my return was rejected that someone else filed using my SSN. I waited, tried again, same error. I called the ID theft dept at IRS. Sure enough, someone else did file, that’s all they could tell me. I had to mail my return, an ID Theft affidavit, copies of ID all in the paper way. Hoping that I don’t have to wait months for a refund. I mailed it Priority with tracking also, better safe than sorry. This is likely happening to many others I bet.grrr

          I’m writing to see if I can give anybody the benefit of my own experience. In 2014 my taxes were rejected because my social security number was used to file. I want to start out by saying, if this happens to you, the IRS will not only make you go through an ID verification process, but the MANDATORY hold on your return is 180 DAYS or 6 months before they will release your refund. They do not care that you are the victim. It’s you who are punished.

          This new EITC delay is the net result of people who are not US citizens (I.e. Illegals) and what they have been doing is stealing social security numbers and claiming multiple people’s taxes and asking for EITC’s for stolen children’s social security numbers. They have people who have filed 30 and 40 times and claiming 5 kids. THE THEFTS ARE IN THE BILLIONS. These people are never caught and even when they are, the IRS has been soft on them. SO this new PATH legislature was passed in order to deter these thefts but, again, punishing Americans who hVe done nothing wrong.

          People need to wake up and understand the high cost of bringing illegals into this country. I would be willing to bet, the people here complaining about the delay have no idea that the thing holding up their return is the result of illegals. BUT I have a friend who works for the IRS and she told me that this is the reason. I googled it and it seems to be confirmed in some of the articles I read.

            Does anyone have an update about how long it took to get your refunds? I’m going through the same thing and have yet to see anything on wmr. Someone please share your outcome. Thanks

              I was a victim of ID theft for the 2014 tax year. It was a nightmare. I e filed early February and had my paper mail stamped by my local IRS office a week later. 4 weeks later I contacted them to follow up on the status. Turned out there was a delay because my local office sent it to VA, and then it had to be sent to CA, because that location dealt with my state. By May, nothing had been updated. With no notice, I saw my deposit come through to my bank the last week in July. I was notified I would need an pin to file for 2015 and I would receive a letter in December. After not receiving any such letter, I contacted the IRS in January and they verified that The “id pin” I was supposed to receive for the 2015 tax year was sent to the address on the fraudulent return.

              Whats the deal

                I FILED ON 1/14/2016 ACCEPTED ON 1/15/2016. I HAD ONE BAR AND THEN IT WENT AWAY ON 2/1/2016. SINCE THEN NO BARS, JUST TOPIC 152 AND REFUND AMOUNT. FOR THE FIRST TIME IN MY TAX HISTORY I HAVE GOTTEN MY STATE TAX REFUND BEFORE MY FEDERAL TAX REFUND. ALSO I CALLED 2/8/2016 AND WAS TOLD EVEN THOUGH I WAS ACCEPTED ON 1/15/2016 ALL REFUNDS DIDN’T GET SENT TILL 1/19/2016. I TOLD THE IRS REP THAT EVEN IF SO THAT MAKES IT 20 DAYS TODAY RIGHT. SHE GOES YES YOU ARE CORRECT, BUT I CAN’T EVEN LOOK AT YOUR REFUND OR SEE ANYTHING UNTIL 21 DAYS. SO JUST CALL US TOMORROW. I HAVE GOTTEN NO LETTERS. I USED TURBO TAX ONLINE AND I VERIFIED MY ID WITH THEM AT THE END OF ME FILING. SO AT THIS POINT I AM LIKE WHAT THE HECK IS REALLY GOING ON. DID TURBO TAX MESS UP OUR REFUNDS OR IS THE IRS AND TURBO TAX HAVING SOME TYPE OF BEEF. WHATS THE DEAL? I HAD NO PROBLEM HAVING THEM TAKE THERE MONEY OUT OF MY PAYCHECK. SO NOW ITS TIME TO GIVE ME MY REFUND. STOP CHEATING US

                  I attempted to file my daughters taxes for this year, and we put in that her prior year AGI was 0 since this was the first time she was filing. We were told that her AGI was incorrect because someone did file using her SS# last year. The crazy part is that I claimed her and her daughter last year since I financially supported them while she goes to school and I don’t know how the IRS processed to different returns with the same SS#. We had to mail hers in, and I know it is a 2 month process.

                    Has anyone had any luck with receiving their refund after they were told their SSN was already used? I filed electronically on 2.12, was told my SSN was already used and then sent all of my information in by paper on 2.13 and still no refund. I’ve also been able to check my refund status on WMR previously and it would always say “Processing” but now it is telling me that my information is incorrect? Did anyone have any problems with that happening?

                      Just had the same thing happen to me. I am now getting all the required info. Have you had any luck? All I could find out is it could take up to 180 days…

                        We just found out this happened to us. Someone filed a 1040ez with my husbands social. It was immediately flagged. We are very high income earners and have 3 dependents.

                        Anyway… Our accountant is handling it. We always have to pay, and did not file 2014 yet. So we would not have been waiting for a refund check. Hopefully, it will be straightened out by the time we file so it is not kicked back.

                          i would recommend a tax advocate. i went through that in 2010. now i still have to have an IP every year :/

                            I have the same problem I file January 26 and someone use my SSN too. I’m so passed off I want to my locate IRS office and turn all my stuff in I hope it don’t take long for my refund I need my money!!!!
